Execution of Last Will
If you are executing your Will without the assistance of someone who knows how the Will should be signed properly, please consider the following:
- Two witnesses are required. Make sure the witnesses provide you with their full names and addresses. If you know the witnesses that is even better but make sure they are not minors under the age of 21 or named in your Will.
- If the Will has a self proving Affidavit to be notarized by a notary, then you, the notary and both witnesses should all be present during the entire signing of the Will by you, the witnesses and the notary.
- Again, you, the witnesses and the notary should all be in the presence of each other during signing.
- You should ask the witnesses to witness your Will. “This is my Will. Please witness me execute (sign) it before you sign.” Also do the same for the notary.
That’s about it. The important thing is to do it right, or someone could challenge it later.
